Article 1 – Scope
These Terms of Sale govern all purchases made on lampiero.com. The website is operated by William Jean Swinnen, entrepreneur individuel (EI), trading as Lampiero, with registered address at 19 Rue Saint-Vincent de Paul, 75010 Paris, France, SIRET 97823132200014, email jean@lampiero.com, phone +33 4 88 36 74 40.

By placing an order on the Site, you confirm that you have read and accepted these Terms of Sale. The version applicable to your order is the one in force on the date of purchase.

Article 2 – Products
We make every reasonable effort to present our products as accurately as possible. Product photographs and visual representations are provided for illustrative purposes. Minor differences in appearance may occur depending on screen settings or manufacturing variations.

If a product description contains a material error, we reserve the right to cancel the order and issue a refund. If a product becomes unavailable after an order has been placed, we will inform you and refund the amount paid for the unavailable item.

Article 3 – Prices
All prices shown on the Site are in euros. TVA non applicable, article 293 B du CGI.

Any applicable shipping charges are displayed at checkout before payment. The price payable is the price shown at the moment the order is placed.

Article 4 – Orders
To place an order, you must select the desired product, provide the requested billing and delivery information, verify the order details, accept these Terms of Sale, and complete payment.

Your order is confirmed once payment has been successfully authorised and you receive an order confirmation email. We reserve the right to refuse or cancel an order in the event of payment failure, suspected fraud, abnormal quantities, or an unresolved dispute relating to a previous order.

Article 5 – Payment
Payment is due in full at the time of order. Available payment methods are displayed at checkout. Payments are processed through secure payment providers. We do not store full bank card details.

Article 6 – Delivery
Delivery areas, estimated times, shipping costs, and delivery conditions are set out in our Shipping Policy, which forms an integral part of these Terms of Sale.

Risk of loss or damage passes to the customer upon physical delivery of the goods. If a parcel arrives visibly damaged, the customer must contact us without delay and, where possible, keep the packaging and supporting photographs.

Article 7 – Right of withdrawal

In accordance with applicable EU consumer rules, a consumer has the right to withdraw from the purchase within 14 days from the day of delivery, without giving any reason.

To exercise this right, the customer must send a clear statement of withdrawal by email to jean@lampiero.com before the 14-day period expires.

The product must then be returned without undue delay and no later than 14 days after the withdrawal notice. The customer bears the direct cost of returning the goods unless the item is defective, damaged, incorrect, or not as described.

Under the legal right of withdrawal, the customer may handle the goods only to the extent necessary to establish their nature, characteristics, and functioning. If the goods are returned with handling beyond that standard, Lampiero may apply a deduction for diminished value where permitted by law.

Refunds under the legal right of withdrawal are issued within 14 days from the day we are informed of the withdrawal, but we may defer reimbursement until we have received the returned goods or proof that they have been sent back, whichever comes first.

Article 8 – 30-night sleep guarantee

In addition to the legal right of withdrawal, Lampiero offers a 30-night sleep guarantee for the Lampiero red night light from the date of delivery. To use this commercial guarantee, the customer must contact jean@lampiero.com within 30 days of delivery.

Under this 30-night sleep guarantee, the Lampiero lamp may be used during the 30-night period. It does not need to be unused. It must however be returned in reasonable condition, with its charger and included accessories, and be accompanied by proof of purchase.

The customer bears the return shipping cost unless the product is defective, damaged, incorrect, or not as described. This commercial policy does not limit the customer’s statutory rights.

Article 9 – Legal guarantees
Consumers benefit from the legal guarantee of conformity under articles L217-3 and following of the French Consumer Code and from the guarantee against hidden defects under articles 1641 and following of the French Civil Code.

If a product is defective, non-conforming, or not fit for its normal use, the customer may contact jean@lampiero.com with the order number, a description of the issue, and supporting photographs where relevant.

Article 10 – Returns and refunds
The practical conditions applicable to returns and refunds are set out in the Refund Policy, which forms an integral part of these Terms of Sale.

Article 11 – Limitation of liability
Lampiero shall not be liable for indirect or consequential losses that are not directly caused by a breach of its obligations. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Our products are consumer lighting products. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease.

Article 12 – Intellectual property
All text, visuals, logos, product images, and other content published on the Site are the property of Lampiero or its licensors and may not be reproduced, copied, or used without prior written authorisation.

Article 13 – Personal data
Personal data is processed in accordance with our Privacy Policy.

Article 14 – Consumer mediation
In the event of a dispute, the customer should first contact Lampiero at jean@lampiero.com in order to seek an amicable resolution.

Article 15 – Governing law and jurisdiction
These Terms of Sale are governed by French law. Consumers retain the benefit of any mandatory legal protections applicable in their country of residence within the European Union. In the absence of an amicable resolution, disputes may be brought before the competent courts under applicable law.
